Welcome to persistentelectric.ca (the “Site”). These Terms and Conditions (“Terms”) govern your use of the Site and the services provided by Persistent Electric (“we,” “us,” “our”). By accessing or using the Site, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

Persistent Electric offers professional electrical services, including installation, repair, and maintenance for residential and commercial properties. By engaging our services through the Site or otherwise, you agree to these Terms.

2. Use of the Site

  • Permitted Use: You agree to use the Site solely for lawful purposes and in a way that does not infringe on the rights of others or restrict their use of the Site. You may not use the Site in any way that is fraudulent, harmful, or violates any applicable law or regulation.

3. Service Terms

  • Quotations and Estimates: Any quotes provided by Persistent Electric are valid for 30 days from the date of issuance, unless otherwise stated. Estimates provided through the Site are subject to change based on the actual scope of work and materials required.
  • Service Agreement: By accepting a quote or estimate and engaging Persistent Electric, you enter into a service agreement governed by these Terms. This agreement includes the scope of work, pricing, payment terms, and any other specific conditions detailed in the quote or service agreement.
  • Cancellations: If you wish to cancel or reschedule a service appointment, please notify us at least 24 hours in advance. Cancellations with less than 24 hours’ notice may be subject to a cancellation fee.
  • Warranties and Guarantees: We stand behind the quality of our work. Any warranties or guarantees provided by Persistent Electric will be detailed in your service agreement or invoice. Warranties are void if the electrical work is altered by someone other than Persistent Electric.

4. Pricing and Payment

  • Pricing: All prices for services are stated in Canadian dollars (CAD) and are subject to applicable taxes.
  • Payment Terms: Payment is due upon completion of the service unless otherwise agreed in writing. We accept various forms of payment, including credit cards and electronic transfers.
  • Late Payments: Late payments may be subject to interest at the rate of 10% per month on the outstanding balance.

5. Intellectual Property

  • Ownership: All content on the Site, including text, graphics, logos, images, and software, is the property of Persistent Electric or its content suppliers and is protected by Canadian and international copyright laws.
  • License: You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal or commercial purposes related to the services provided by Persistent Electric. You may not modify, reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.

6. Privacy

7. Limitation of Liability

  • General Liability: To the maximum extent permitted by law, Persistent Electric shall not be liable for any indirect, incidental, special, or consequential damages arising from or in connection with your use of the Site or our services, including but not limited to loss of profits, data, or business opportunities.
  • Service Liability: Persistent Electric’s liability for any claim related to the provision of services shall be limited to the amount you paid for the specific service giving rise to the claim.

You agree to indemnify, defend, and hold harmless Persistent Electric, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Site, your breach of these Terms, or your violation of any law or the rights of a third party.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Calgary, Alberta.

10. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the Site following the posting of any changes constitutes your acceptance of those changes.
